GENERAL TERMS AND CONDITIONS OF SALE<\/strong><\/span><\/p>\n

Article 1. Definitions and scope<\/strong><\/p>\n

 <\/p>\n

These general terms and conditions of sale (the \u201cGeneral Terms\u201d) apply to all orders placed with EASY ESTATE SRL, whose registered office is at Rue Chauss\u00e9e 58, 4342 AWANS, registered with the Belgian Crossroads Bank for Enterprises under number BE 0794.263.219 (the \u201cSeller\u201d).<\/p>\n

These General Terms form the contract between the Seller and the customer. The Seller and the customer are collectively referred to as the \u201cParties\u201d.<\/p>\n

The \u201ccustomer\u201d is any natural or legal person who orders products (registration for an event) from the Seller.<\/p>\n

 <\/p>\n

Only these General Terms apply. In all circumstances, they exclude any general or specific terms of the customer that the Seller has not expressly accepted in writing.<\/p>\n

 <\/p>\n

Entering into any contract or placing any order between the Parties, directly or
electronically, automatically entails the customer\u2019s acceptance of these General Terms.<\/p>\n

 <\/p>\n

The General Terms are freely accessible at any time on the Seller\u2019s website, https:\/\/easy-estate.be. By placing an order, the customer therefore declares that they have read these General Terms and confirms their acceptance of the associated rights and obligations.<\/p>\n

 <\/p>\n

The Seller reserves the right to amend these General Terms at any time without prior notice, provided that the amendments are published on its website.<\/p>\n

Such amendments will apply to all orders placed thereafter.<\/p>\n

The commercial website https:\/\/easy-estate.be<\/a> (the \u201cWebsite\u201d) is an online shop hosted by OVH.net and open to all internet users and customers.<\/p>\n

Article 3. Customer\u2019s legal capacity<\/strong><\/p>\n

A customer wishing to make a purchase on the Website declares that they have full legal capacity to enter into a purchase contract on the Website. Where the purchase is made on behalf of a company, the internet user declares that they are authorised to bind that company.<\/p>\n

Article 4. Intellectual property<\/strong><\/p>\n

Unless otherwise expressly agreed in advance, the customer may not modify, reproduce, rent, borrow, sell, distribute or create derivative works based, in whole or in part, on material appearing on the Seller\u2019s Website or in its catalogue.<\/p>\n

Images, texts, graphics, information and specifications illustrating goods, and all other material on the Website, are provided for information only and have no contractual value; their purpose is to help the customer make a choice. Consequently, the Seller cannot be held liable for any errors or omissions in such material.<\/p>\n

Unless expressly stated otherwise, the agreed price does not include any transfer of
intellectual and\/or industrial property rights of any kind.<\/p>\n

Under no circumstances do the details and information on the Website constitute, or
should they be regarded as, a recommendation for preventive or curative treatment, a prescription or a diagnosis. Only a doctor or healthcare professional can properly assess the health of a customer or internet user. Accordingly, the company also accepts no liability for any content, goods or services that may be offered there, their compliance with laws and regulations, or third-party websites linked from the Website.<\/p>\n

The company cannot be held liable for damage to the customer\u2019s computer caused by computer viruses transmitted via the internet; damage resulting from misuse of the Website; unauthorised reproduction or use of any Website material; or damage caused by data interception through hacking.<\/p>\n

Article 5. Offers and orders<\/strong><\/p>\n

 <\/p>\n

To place an order, the customer selects the product(s) (event) they wish to order, provides the requested contact details, checks that the order is correct and then pays for it.<\/p>\n

 <\/p>\n

Once the bank confirms payment, the Seller sends the customer an order summary stating, in particular, the order number, the products ordered and their prices, together with these General Terms or a link to them.<\/p>\n

 <\/p>\n

The Seller reserves the right to suspend, cancel or refuse a customer\u2019s order, particularly where the information provided by the customer is clearly incorrect or incomplete or there is a dispute concerning payment for a previous order.<\/p>\n

If the customer cancels an order less than two working days (48 hours) before the scheduled date of the event, for any reason whatsoever, no refund may be claimed. The full amount paid will remain with the Seller, who will retain it in its entirety and invoice the customer accordingly.<\/p>\n

Article 6. Prices<\/strong><\/p>\n

 <\/p>\n

Payments must be made in euros by bank transfer or secure online payment (Mollie). Invoices are payable in advance.<\/p>\n

 <\/p>\n

Product prices are stated in euros, inclusive of all taxes. Prices displayed on the Website or in catalogues and brochures are indicative only. The company reserves the right to change its prices at any time. Only the prices stated on invoices are binding.<\/p>\n

 <\/p>\n

Any increase in VAT or any new tax imposed between the time of ordering and delivery will automatically be borne by the customer.<\/p>\n

 <\/p>\n

Complaints relating to invoices must reach the company within eight calendar days of receipt of the invoice.<\/p>\n

Article 7. Order cancellation<\/strong><\/p>\n

 <\/p>\n

A customer wishing to cancel an order shall inform the Seller, who will explain the procedure to follow.<\/p>\n

If the customer cancels an order less than two working days (48 hours) before the scheduled date of the event, for any reason whatsoever, no refund may be claimed. The full amount paid will remain with the Seller, who will retain it in its entirety and invoice the customer accordingly.<\/p>\n

Article 8. Availability<\/p>\n

The products\/events offered for sale by the Seller are subject to availability.<\/p>\n

If one or more products\/events become unavailable after payment, the Seller undertakes to inform the customer as soon as possible and to offer a choice between a refund and postponing participation to a future event.<\/p>\n

Article 9. Liability<\/strong><\/p>\n

 <\/p>\n

The customer acknowledges and accepts that all of the Seller\u2019s obligations are obligations of reasonable efforts only, and that the Seller is liable solely for wilful misconduct and gross negligence.<\/p>\n

 <\/p>\n

If the customer proves gross negligence or wilful misconduct on the part of the Seller, the loss for which the customer may claim compensation is limited to material damage directly resulting from the fault attributable to the Seller, to the exclusion of all other loss. In all circumstances, compensation may not exceed 75% (excluding taxes) of the amount actually paid by the customer under the order.<\/p>\n

The Seller is likewise not liable if the customer provides incorrect information or if a third party places an order in the customer\u2019s name.<\/p>\n

Article 10. Internet and new technologies<\/strong><\/p>\n

The customer acknowledges the limitations and risks associated with using the internet or any other means by which the Website is currently, or may in future be, made available. The customer also acknowledges the risks of storing and transmitting information digitally or electronically.<\/p>\n

 <\/p>\n

The customer accepts that the Seller cannot be held liable for damage caused by use of the Seller\u2019s Website (including any applications) or the internet as a result of the above risks.<\/p>\n

 <\/p>\n

The customer further accepts that electronic communications exchanged and backups made by the Seller may serve as evidence.<\/p>\n

Article 11. User comments, suggestions and other submissions<\/strong><\/p>\n

 <\/p>\n

A customer who sends or publishes creative ideas, suggestions, comments or proposals online, by email, by post or otherwise grants the Seller the unrestricted right, at any time and in any medium, to edit, copy, publish, distribute, translate and otherwise use those comments, ideas or suggestions.<\/p>\n
